Terms of Service
These Terms of Service ("Terms") govern your access to and use of the Spontificant mobile application, related websites, and services (collectively, the "Service"). The Service is operated by High Wire Development LLC ("High Wire," "we," "us," or "our").
By using Spontificant, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
Spontificant helps you create reminders that appear at randomized times throughout the day using local notifications on your device. The Service may include free features and paid premium features, such as additional reminder capacity, premium content packs, multi-message reminder pools, advanced scheduling options, and server sync.
We may modify, suspend, or discontinue any part of the Service at any time, subject to applicable law and any obligations related to paid subscriptions.
2. Eligibility
You must be at least 13 years old to use Spontificant. If you are under the age of majority where you live, you may use the Service only with permission from a parent or legal guardian.
You are responsible for complying with all laws and regulations that apply to your use of the Service.
3. Accounts
Some features may require you to create or sign in to an account using Apple, Google, or another supported sign-in provider. You are responsible for maintaining the security of your account and for all activity that occurs through your account.
You agree to provide accurate information and to notify us promptly if you believe your account has been compromised.
4. Reminders and User Content
You are responsible for the reminders, messages, titles, schedules, and other content you create or store using the Service ("User Content").
You retain ownership of your User Content. You grant High Wire a limited, non-exclusive, worldwide license to host, process, transmit, display, and otherwise use your User Content solely as needed to provide, maintain, secure, and improve the Service.
You agree that your User Content and use of the Service will not:
- Violate any law or regulation.
- Infringe, misappropriate, or violate anyone else's rights.
- Harass, threaten, abuse, or harm another person.
- Contain unlawful, hateful, sexually exploitative, or otherwise abusive material.
- Interfere with the operation or security of the Service.
5. Notifications and Reminder Timing
Spontificant uses device-local notification systems. Reminder delivery may depend on operating system behavior, device settings, battery optimization, permissions, time zone changes, network availability, and other conditions outside our control.
6. Premium Features and Subscriptions
Spontificant may offer paid subscriptions or other paid features. Purchases are processed through Apple App Store, Google Play, or another authorized payment provider.
Subscription availability, pricing, renewal, cancellation, refunds, trials, and billing are governed by the applicable app store or payment provider terms, unless we state otherwise. We do not control app store billing systems.
You may cancel a subscription through your Apple App Store or Google Play account settings. Deleting your Spontificant account or uninstalling the app does not automatically cancel a subscription.
We may change free or premium feature limits from time to time. If we make material changes to paid features, we will handle them in accordance with applicable law and app store rules.
7. Third-Party Services
The Service may rely on third-party services, including Apple, Google, RevenueCat, AWS, and Supabase. Your use of those services may be subject to their own terms and policies.
We are not responsible for third-party services, app stores, devices, operating systems, or networks that we do not control.
8. App Store Terms
If you download Spontificant from the Apple App Store or Google Play, your use of the app is also subject to the applicable app store terms. Apple and Google are not responsible for providing support for the Service unless their own terms require otherwise.
For iOS users, we do not provide a separate custom end user license agreement. Your Terms of Use (EULA) is Apple's standard licensed application end user license agreement, available at apple.com/legal/internet-services/itunes/dev/stdeula/. See our EULA page for more detail.
9. Acceptable Use
You agree not to:
- Reverse engineer, decompile, or attempt to extract source code except as permitted by law.
- Interfere with, disrupt, or overload the Service.
- Attempt to access accounts, systems, or data without authorization.
- Use automated tools to abuse, scrape, or attack the Service.
- Circumvent feature limits, subscription checks, security controls, or access restrictions.
- Use the Service to create or distribute unlawful, abusive, deceptive, or harmful content.
10. Termination
You may stop using the Service at any time. You may delete your account through the app where account deletion is available.
We may suspend or terminate access to the Service if we reasonably believe you have violated these Terms, created risk for other users or the Service, or used the Service unlawfully.
11. Disclaimers
The Service is provided "as is" and "as available." To the fullest extent permitted by law, High Wire disclaims all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
We do not warrant that the Service will be uninterrupted, accurate, secure, error-free, or that reminders will be delivered at any specific time.
12. Limitation of Liability
To the fullest extent permitted by law, High Wire and its owners, employees, contractors, service providers, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, lost goodwill, or service interruption.
To the fullest extent permitted by law, High Wire's total liability for any claim related to the Service will not exceed the greater of: (a) the amount you paid to High Wire for the Service in the 12 months before the event giving rise to the claim; or (b) USD $100.
Some jurisdictions do not allow certain limitations of liability, so some limitations may not apply to you.
13. Indemnity
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless High Wire and its owners, employees, contractors, service providers, and affiliates from and against claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising from or related to your use of the Service, your User Content, or your violation of these Terms.
14. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will provide notice as required by law. Your continued use of the Service after changes become effective means you accept the updated Terms.
15. Governing Law
These Terms are governed by the laws of the State of Idaho, without regard to conflict of law rules, except where applicable law requires otherwise.
